VIDEO AND INTERVIEW CONSENT AND RELEASE FORM

I, hereby authorize Adventure Holdings to publish, reproduce, record, display, capture,  or otherwise use my name, voice, image, and likeness (collectively, the “likeness”), in video, photographs, written materials, and audio-visual recordings (the “Recordings”), for any purpose you may intend, as long as such Recordings are not used to defame or slander me, or spread false information. I acknowledge and understand these Recordings about or of me may be used for both commercial and/or non-commercial purposes.

I understand that my likeness/Recordings may be edited, copied, exhibited, published and/or distributed. I also understand the Recordings/likeness may be used individually or in conjunction with other media in any medium, including without limitation to print publications, digital publications, and/or public broadcast for any lawful purpose. There is no time limit on the validity of this release nor is there any geographic limitation on where these materials/my likeness may be distributed. Furthermore, unless agreed otherwise with Adventure Holdings, I hereby provide Adventure Holdings with a/an irrevocable, royalty free, worldwide, unrestricted, perpetual, sublicensable, perpetually and fully assignable, and unlimited license to utilize my likeness as contained in the Recordings, for any lawful purpose. I hereby acknowledge and agree that Adventure Holdings shall have all rights of ownership to the Recordings and the content contained therein, and to the extent I may have any ownership or copyrights in the Recordings, I hereby fully assign and transfer such rights to the Released Party hereunder. If such an assignment or transfer is not possible, I hereby provide Adventure Holdings with a /an irrevocable, royalty free, worldwide, unrestricted, perpetual, sublicensable, perpetually and fully assignable, and unlimited license to utilize such copyrights and intellectual property as contained in the Recordings, for any lawful purpose. Furthermore, I hereby waive any moral rights I may have in any content contained in the Recordings, to the greatest extent permitted under applicable law. 

I hereby acknowledge and grant Adventure Holdings and its employees, agents, licenses, successors, and third-party organizations all ownership rights and the irrevocable right and permission to use, copyright, publish, sell, distribute, and/or promote the Recordings, including recorded video, photo, interview, and/or audio, which contain my likeness.

I understand my participation is voluntary and that I may, at any time, discontinue my involvement before signing this document. If I choose to discontinue participation, I will notify the principal parties Adventure Holdings by providing written notice.

I understand that Adventure Holdings can see no unreasonable risks presently associated with my participating in the Recordings, and that I take full responsibility for my involvement in this project and the risks that it may entail (be they legal, physical, or mental) and release Adventure Holdings from any claims, demands, losses, damages, or  suits, I may have, and any liabilities of any kind whatsoever in connection with the foregoing, and the provision of my likeness, as well as my participation in the Recordings.

I hereby certify that I am over eighteen years of age and am competent to contract in my own name insofar as the above is concerned. If I am under eighteen years of age, my parents or legal guardians have read this document and have given their consent by signing below.

This waiver and release form shall be governed in accordance with the laws of the State of Delaware, and all disputes arising hereunder shall be subject to the exclusive jurisdiction of the competent courts located in the State of Delaware.

In the event that any provision of this waiver and release form shall be found to be void or unenforceable, such findings shall not be construed to render any other provision of this waiver and release either void or unenforceable, and all other provisions shall remain in full force and effect.

By signing this form, I acknowledge that I have completely read and fully understand the above consent and release and agree to be bound thereby. I hereby release any and all claims against any person or organization utilizing my likeness in the Recordings for marketing, educational, promotional, and/or any other lawful purpose whatsoever.

I hereby agree to the terms of this waiver, and acknowledge that I have been offered good and valuable consideration in exchange for providing my likeness as described hereunder, and I enter into this waiver and release agreement of my own will and discretion, intending to be legally bound.
